Terms & Conditions

Please read these Terms & Conditions ("Terms") carefully before engaging the services of cloudMarilaut ("we", "us", or "our"). By placing an order or making payment, you ("Client") agree to be bound by these Terms.
1. Services Provided
cloudMarilaut provides static website design, development, hosting setup, domain registration, and related web services as described on our website and in our project proposals. The specific scope of work will be agreed upon in writing before any project commences.
2. Scope of Work & Limitations
- Each project is limited to a maximum of 5 static, informational pages.
- We do not build dynamic web applications, e-commerce platforms, membership sites, or systems requiring user logins or custom databases unless explicitly agreed in writing.
- The 3-business-day delivery window commences only upon receipt of 100% of client-supplied content, including all text, images, and logo files.
- Each project includes a maximum of 2 rounds of revisions. Additional revision requests beyond this will be billed at RM 99/hour.
- Scope changes requested after the project has commenced may affect delivery timelines and will be subject to additional charges.
3. Client Responsibilities
The Client agrees to:
- Provide all required content (text, images, logos, branding materials) before the project commences.
- Ensure all content provided is original or that the Client has the legal right to use it. cloudMarilaut accepts no liability for copyright infringement resulting from client-supplied content.
- Respond promptly to requests for feedback, approvals, and clarifications. Delays caused by the Client may extend the delivery timeline.
- Review and approve or request revisions within 5 business days of receiving a staging link.
4. Payment Terms
- A 50% deposit is required before any work commences.
- The remaining 50% balance is due upon completion, before the website goes live.
- Monthly or annual retainer fees are billed in advance and are non-refundable once the service period has commenced.
- Ad-hoc support is billed at RM 99/hour, invoiced upon completion of work.
- All prices are in Malaysian Ringgit (MYR) and are inclusive of applicable taxes unless stated otherwise.
5. Refund Policy
- Deposits are non-refundable once work has commenced.
- If the Client cancels after the project has started but before completion, the deposit is forfeited and any additional work completed will be invoiced pro-rata.
- If cloudMarilaut is unable to deliver the project due to our own default, a full refund of payments made will be issued.
6. Intellectual Property & Ownership
- Upon receipt of final payment, the Client owns all custom website files and design assets created for their project.
- cloudMarilaut retains the right to display completed projects in our portfolio and marketing materials, unless the Client requests otherwise in writing.
- Any third-party assets (fonts, stock photography, icons) remain subject to their respective licences. The Client is responsible for ensuring appropriate licensing for third-party content they request.
7. Hosting & Domain
- The Launch Package includes 1 year of domain registration and hosting. The Client is responsible for renewal fees (RM 199/year) from Year 2 onwards.
- If the Client chooses not to renew, the website will be taken offline. cloudMarilaut will provide the Client with all website files upon request.
- We are not liable for downtime caused by third-party hosting providers, domain registrars, or circumstances outside our control.
8. Retainer & Maintenance Plans
- Monthly retainer: RM 99/month, billed monthly in advance.
- Annual retainer: RM 900/year, billed annually in advance.
- Retainer plans include up to 2 hours of content updates per month. Unused hours do not roll over to the following month.
- Retainer subscriptions may be cancelled with 30 days' written notice. No refunds will be issued for the current billing period.
9. Limitation of Liability
To the fullest extent permitted by law, cloudMarilaut shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities, arising from the use of or inability to use our services. Our total liability to the Client shall not exceed the total amount paid by the Client for the specific project or service giving rise to the claim.
10. Indemnification
The Client agrees to indemnify and hold harmless cloudMarilaut, its employees, and contractors from any claims, damages, or expenses (including legal fees) arising from: (a) content provided by the Client that infringes third-party rights; (b) the Client's misuse of the delivered website; or (c) breach of these Terms by the Client.
11. Governing Law
These Terms are governed by the laws of Malaysia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
12. Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services after such changes constitutes acceptance of the updated Terms.
